fa ابعاد حقوقی و الزامات مسئولیت پزشک در درمان دریانوردان از طریق تله‌مدیسین: رویکردی بین‌المللی طب دریا Marine Medicine پژوهشي اصیل Original Article <div style="text-align: justify;"><span style="color:#000000;"><span style="font-family:IRANyekan;"><span style="font-size:12px;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" times=""><b><span b="" lang="FA" mitra="">زمینه و هدف: </span></b><span b="" lang="AR-SA" mitra="">با گسترش فناوری‌های ارتباطی، استفاده از پزشکی از راه دور (تله‌مدیسین) در کشتی‌ها به‌عنوان راهکاری مؤثر برای رفع محدودیت‌های جغرافیایی و تأمین مراقبت‌های بهداشتی دریانوردان اهمیت فزاینده‌ای یافته است. با این حال، پیچیدگی‌های حقوقی و اخلاقی مرتبط با مسئولیت پزشکان در فرآیندهای تشخیص، تجویز و پیگیری درمان از راه دور، چالش‌های جدیدی ایجاد کرده است. این پژوهش با هدف تحلیل نظام‌مند ابعاد حقوقی و اخلاقی مسئولیت پزشک در ارائه خدمات تله‌مدیسین به دریانوردان انجام شده و در پی ارائه چارچوبی روشن برای تعیین حدود تعهدات و مسئولیت‌های پزشک، مالک کشتی و دولت صاحب پرچم است.</span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" times=""><b><span b="" lang="AR-SA" mitra="">روش‌ها: </span></b><span b="" lang="AR-SA" mitra="">این مطالعه از نوع توصیفی</span>&ndash;<span b="" lang="AR-SA" mitra="">تحلیلی است. داده‌های مورد نیاز از طریق بررسی اسناد و مقررات بین‌المللی شامل کنوانسیون کار دریایی (</span><span b="" lang="FA" mitra="">۲۰۰۶)</span><span b="" lang="AR-SA" mitra="">، کنوانسیون سولاس، دستورالعمل‌های سازمان جهانی بهداشت و میثاق‌های حقوق بشری مرتبط گردآوری و با روش تحلیل محتوای کیفی مورد ارزیابی قرار گرفته‌اند.</span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" times=""><b><span b="" lang="AR-SA" mitra="">یافته‌ها: </span></b><span b="" lang="AR-SA" mitra="">یافته‌ها نشان می‌دهند که تله‌مدیسین ابزاری ضروری برای تحقق حق دسترسی به سلامت دریانوردان محسوب می‌شود. مسئولیت حقوقی و حرفه‌ای پزشک در قبال قصور در تشخیص یا درمان، حتی در بستر مجازی، برقرار است. همچنین، دولت‌های صاحب پرچم و مالکان کشتی موظف‌اند زیرساخت‌های ارتباطی ایمن، تجهیزات پزشکی پایه و پروتکل‌های محرمانگی و امنیت داده‌های بهداشتی را فراهم کنند.</span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" times=""><b><span b="" lang="AR-SA" mitra="">نتیجه‌گیری: </span></b><span b="" lang="AR-SA" mitra="">کاربرد پزشکی از راه دور در محیط دریایی نه‌تنها امکان دسترسی عادلانه‌تر به خدمات درمانی را فراهم می‌آورد، بلکه مستلزم بازنگری در قوانین و مقررات بین‌المللی و داخلی برای تعیین دقیق حدود مسئولیت‌ها و حمایت از حقوق تمام ذی‌نفعان است. تعریف روشن مرزهای مسئولیت پزشک و تضمین حمایت‌های حقوقی مؤثر برای دریانوردان می‌تواند به ارتقای استانداردهای سلامت، ایمنی و اخلاق حرفه‌ای در دریا منجر شود.</span></span></span></span></span></span></span></span></div> <div class="WordSection1" style="text-align: justify;"><span style="font-size:12pt"><span style="line-height:115%"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:10.0pt"><span style="line-height:115%">Background and Aim: </span></span></b><span style="font-size:10.0pt"><span style="line-height:115%">With the advancement of communication technologies, the use of telemedicine aboard ships has gained increasing importance as an effective solution to overcome geographical barriers and provide healthcare services to seafarers. However, the legal and ethical complexities associated with physicians&#39; liability in remote diagnosis, prescription, and treatment follow-up have introduced new challenges. This study aims to systematically analyze the legal and ethical dimensions of physician liability in delivering telemedicine services to seafarers and seeks to propose a clear framework for defining the obligations and responsibilities of physicians, shipowners, and flag states.</span></span></span></span></span></span><br> <span style="font-size:12pt"><span style="line-height:115%"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:10.0pt"><span style="line-height:115%">Methods:</span></span></b><span style="font-size:10.0pt"><span style="line-height:115%">&nbsp;This study employs a descriptive-analytical approach. Data were collected through a review of international documents and regulations, including the Maritime Labour Convention (2006), the SOLAS Convention, World Health Organization guidelines, and relevant human rights covenants. The data were evaluated using qualitative content analysis.</span></span></span></span></span></span><br> <span style="font-size:12pt"><span style="line-height:115%"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:10.0pt"><span style="line-height:115%">Results:</span></span></b><span style="font-size:10.0pt"><span style="line-height:115%">&nbsp;The findings indicate that telemedicine is an essential tool for realizing seafarers&#39; right to health. Physicians retain legal and professional liability for negligence in diagnosis or treatment, even in a virtual setting. Additionally, flag states and shipowners are obligated to provide secure communication infrastructure, basic medical equipment, and protocols for data confidentiality and security.</span></span></span></span></span></span><br> <span style="font-size:12pt"><span style="line-height:115%"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:10.0pt"><span style="line-height:115%">Conclusion:</span></span></b><span style="font-size:10.0pt"><span style="line-height:115%">&nbsp;The application of telemedicine in the maritime context not only enables more equitable access to healthcare services but also necessitates a revision of international and domestic legal frameworks to precisely delineate liability boundaries and protect the rights of all stakeholders.
